Birlea triumphs in IP dispute

After a two-year process, the High Court of Justice, Intellectual Property Enterprise Court, has ruled in favour of Birlea Furniture Ltd in a dispute against Platinum Enterprise UK Ltd (t/a Bedzonline) – and also against one of its directors, Raheel Baig, who was found to be personally liable.

The court held that Platinum and Mr Baig were guilty of trademark infringement by selling beds on Amazon under the Birlea name that were not Birlea beds. 

Jake Magill, director of Birlea, says: “We felt obligated to take action in this case for our customers and to protect consumers, some of whom will have bought inferior products from Bedzonline believing them to be from Birlea.”

Joe Magill, also a director, adds: “We source quality products from around the world and with solid ethical credentials. We pride ourselves on delivering a friendly, professional service. Consumers need to be confident about where goods come from when buying online. There are too many unscrupulous traders and so it is important that we took action in this case.” 

Platinum and Mr Baig were ordered to pay Birlea's legal costs on an indemnity basis.
